Terms and Conditions – Forvino B.V.
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Consumer: a natural person who is not acting in the course of a profession or business.
Business customer: any legal entity or natural person acting in the course of a profession or business.
Customer: both consumers and business customers.
Forvino: Forvino B.V., trading under the name Forvino Wine Cooling.
Distance contract: a contract concluded between Forvino and a customer via the website or other forms of distance selling.
Right of withdrawal: the consumer’s right to cancel the agreement within 14 days of receiving the product.
Durable medium: any medium that allows the customer to store information and consult it later without alteration (such as email).

Article 3 – Applicability
Any deviating terms and conditions of the customer shall only apply if accepted in writing by Forvino.
If any provision is invalid, the remaining provisions shall remain in full force and effect
Article 4 – The Offer
Forvino is not bound by obvious errors or mistakes.
Specific terms and conditions may apply to business customers (such as volume discounts or payment terms).
Article 5 – Formation of the Agreement
Forvino confirms orders electronically (via email).
Forvino reserves the right to refuse orders or impose special conditions if there are reasonable grounds for doing so.
Article 6 – Right of Withdrawal (Consumers)
In the event of cancellation, the product must be returned within 14 days of notification.
Return shipping costs are the responsibility of the consumer, unless otherwise agreed.
Exceptions: custom-made products and products that cannot be returned for hygienic reasons if the seal has been broken.
Article 7 – Return Policy for Business Customers
Business customers do not have a legal right of withdrawal.
Returns by business customers are only possible with Forvino’s prior written consent and subject to conditions determined by Forvino.
Article 8 – Obligations During the Cooling-Off Period (Consumers)
The consumer may only handle the product as they would in a physical store. In the event of further use, the consumer is liable for any loss in value.
Article 9 – Consequences of withdrawal
Forvino will refund all payments, including shipping costs, within 14 days of receiving the returned product or proof of return.
Refunds will be issued via the same payment method, unless otherwise agreed.
Article 10 – Transfer of Ownership
All products delivered remain the property of Forvino until the customer has paid the purchase price in full.
Forvino may exercise its right of retention until the customer has paid in full.
Article 11 – Prices and Payment
Prices for consumers include VAT; prices for business customers exclude VAT, unless otherwise stated.
Payment must be made within 14 days of the invoice date, unless otherwise agreed.
Statutory interest is due in the event of late payment; business customers are also liable for extrajudicial collection costs.
Article 12 – Delivery and Performance
Delivery will be made to the address provided by the customer, always in consultation and by appointment with the customer.
Forvino generally delivers orders within 7 days of the conclusion of the agreement, unless otherwise agreed in writing or the product is out of stock.
If delivery at the agreed time proves impossible due to circumstances on the customer’s part, Forvino has the right to charge additional delivery and administrative costs.
The risk of damage and loss passes to the customer upon delivery.
For deliveries outside the Netherlands, additional terms and conditions apply regarding delivery time, shipping costs, and transfer of risk, which will be explained by Forvino in advance.
Inspection upon delivery – consumers (B2C): the consumer must inspect the packaging and product for visible damage immediately upon delivery. Any visible damage must be reported immediately to the delivery person and Forvino. In the event of damage discovered later (hidden damage), this must be reported within a reasonable period after discovery.
Inspection upon delivery – business customers (B2B): the business customer is obligated to unpack the product immediately upon delivery and inspect it for visible damage. If the customer signs for receipt without noting any damage, the delivery is deemed to have been received in good order and the customer can no longer claim transport damage. All resulting costs are the responsibility of the business customer.
Article 13 – Installation and Use
The customer is required to carefully read the included manual before using or installing the product, and to strictly adhere to the regulations and safety instructions contained therein.
Products must be installed and used exclusively in accordance with the manual or Forvino’s instructions. In particular, the requirements for proper installation, placement, and ventilation of the device apply.
If the product is not installed or used in accordance with the installation instructions and ventilation requirements, any warranty claims and liability shall lapse.
Forvino is not liable for damage resulting from improper installation, insufficient ventilation, misuse, or failure to comply with the instructions in the manual.
Article 14 – Warranty and Conformity
Forvino guarantees that all products delivered comply with the agreement, the stated specifications, and reasonable standards of quality and usability.
Every customer is entitled to a full 2-year warranty starting from the delivery date.
